Terms of Service

These Terms govern your use of Instaroom AI. By creating an account or using the app, you agree to them. Please read them — especially the sections on subscriptions, generated output, and the design disclaimer.

1Who operates the service

Instaroom AI (the "Service") is operated by Kirill Kazakov. You can reach us at instaroom.team@gmail.com.

2Eligibility

You must be legally permitted to use the Service in your jurisdiction. The Service is not intended for children. If you use it on behalf of an organization, you confirm you have authority to accept these Terms for it. We may refuse, limit, or suspend access for compliance or fraud-prevention reasons.

3Description of the service

Instaroom AI provides AI-assisted interior design and room visualization. You provide a photo of a real space and choose how to change it — restyling walls, floors, lighting and decor; transferring a reference room's style; or removing clutter and distractions — and the Service returns a photorealistic redesign of that space.

The Service is provided for inspiration, planning, and entertainment. It is not professional architectural, structural, engineering, or contractor advice.

4Accounts

The Service may sign you in automatically to preserve your designs and subscription across sessions. You are responsible for activity that occurs through your account except where caused by our failure to apply reasonable security measures. We may suspend accounts involved in violations, misuse, or unlawful activity.

5License to use the service

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service. You may not copy, modify, reverse engineer, resell, commercially exploit, build a competing product from, or use automated means to access the Service, or remove any proprietary notices.

6Subscriptions, billing, and free trials

Some features require a paid subscription. Subscriptions automatically renew unless cancelled before the renewal date. Where a free trial is offered, it automatically converts to a paid subscription unless cancelled before it ends. Billing and cancellation are managed through your app-store account — deleting the app does not cancel a subscription.

7Generation limits and fair use

The number of redesigns available depends on your plan and may vary by region. Unused generations do not roll over between periods, and allowances are non-transferable. We may apply fair-use limits and block excessive or abusive usage that threatens Service stability or cost.

8Refunds

Fees are generally non-refundable once charged, except where required by law. Refund requests are handled through the applicable app store's procedures. Cancelling stops future charges but does not refund the current period.

9Your content

You keep ownership of the photos and prompts you provide ("User Content"). You grant us a limited license to process them to operate the Service, generate your output, troubleshoot, and comply with law. You confirm you own or have permission to use everything you upload — including images that may show your home, other people, or personal items — and that doing so does not violate anyone's rights or privacy.

10AI processing and third-party providers

Your content may be processed by third-party AI and cloud infrastructure (such as Google Gemini, accessed via OpenRouter) solely to provide the Service. We do not use your User Content to train third-party AI models except with clear disclosure and any consent required by law. Processing is subject to those providers' limitations.

11Generated output

To the extent permitted, rights in the images the Service generates for you are assigned to you. However, we do not guarantee that generated output is unique, non-infringing, accurate, realistic, buildable, safe, lawful, or fit for any particular purpose. Similar output may be generated for other users.

12Acceptable use

You agree not to use the Service to create or upload: illegal or infringing content; sexual content involving minors; content promoting violence or hatred; malware; impersonation; or content that violates others' privacy or confidentiality. You also may not bypass limits, abuse accounts, scrape, or attempt unauthorized access.

14Third-party services and app stores

The Service relies on external providers whose terms also apply to you. App stores are not responsible for the Service. We do not control the actions or policies of third parties.

15External links and product suggestions

Any third-party links, products, or materials surfaced in the Service are not endorsed or guaranteed. You are responsible for verifying products, materials, measurements, suppliers, and applicable laws before purchasing. Transactions with third parties are solely between you and them.

16Intellectual property in the service

The Service, including its software, design, and branding, is protected by intellectual-property laws. You may not copy, modify, distribute, or reverse engineer it without permission. If you send us feedback, we may use it without obligation or compensation.

17Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we process personal data.

18Account and data deletion

You can request deletion of your account and data from within the app's Settings or by emailing us. Deletion removes your account data, subject to limited legal and security retention. Subscriptions must be cancelled separately through your payment provider.

19Suspension and termination

We may suspend or terminate access for violations, legal requirements, or risk to the Service or others. Termination ends your right to use the Service immediately. Provisions that by their nature should survive — including payment, IP, disclaimers, and liability limits — continue to apply.

20Service availability and changes

We may modify, update, suspend, limit, replace, or discontinue all or part of the Service at any time. We do not guarantee continuous availability or compatibility with every device.

21Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, including merchantability and fitness for a particular purpose. We make no guarantees regarding output quality, accuracy, safety, or legality.

22Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages. Our total liability for any claim will not exceed the amount you paid us during the 12 months before the event giving rise to the claim.

23Indemnity

You agree to indemnify us against claims arising from your misuse of the Service, your User Content, your violation of these Terms or any law, your infringement of third-party rights, and any real-world implementation of generated designs.

24Changes to these terms

We may update these Terms and will provide notice through reasonable channels. Continued use after changes take effect means you accept the updated Terms.

25Assignment

You may not assign your rights under these Terms without our permission. We may assign ours, for example in a merger or acquisition.

26Severability

If any provision is found invalid, the remaining provisions remain in full effect.

27Entire agreement

These Terms, the Privacy Policy, and any feature-specific terms form the entire agreement between you and us. Where they conflict, the more specific terms control.

28Governing law and disputes

These Terms are governed by the laws of the Czech Republic, and the Czech courts have jurisdiction, unless mandatory consumer-protection laws in your country of residence provide otherwise. We will attempt to resolve disputes informally first.
